He retired from that office December 31,completing 44 years of public service to both his country and to his community.

He also wrote out drafts of replies for his clerks to copy. He spent freely for his own village of Peterboro, providing for flagstone walks, swamp drainage, and the building of roads. Legal documents relate primarily to Smith's extensive land holdings and his position as county judge. Correspondents are listed alphabetically by last name and then chronologically under each name. He had been a man of personal as well as religious peculiarities for much of his life, and despite his financial successes he grew morose at the end, claiming that he was "a trouble to himself and a vexation to those about him. Smith's grandfather, Colonel James Livingston, fought in the American Revolution and his first cousin, Elizabeth Cady Stanton, was a founder and leader of the women's suffrage movement.
